Terms of Service

Welcome to AwayOps. By creating an account or using our platform, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use AwayOps.
1. Definitions
- AwayOps — the leave and attendance management platform operated by AwayOps Ltd.
- Customer / Company — the organisation that registers a workspace.
- Users — employees, managers, and admins added to a Customer's workspace.
- Workspace — the isolated environment provisioned for a Customer at their chosen subdomain.
2. Accounts & Registration
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at awayops.solution@@gmail.com of any unauthorised access.
Each workspace is tied to one company. You may not resell, sublicense, or share access to your workspace with third parties outside your organisation.
3. Free Trial
New accounts receive a 14-day free trial with full feature access. No credit card is required to begin. At the end of the trial, you may subscribe to a paid plan or your workspace will be suspended. Data is retained for 30 days after suspension before deletion.
4. Subscriptions & Billing
Paid plans are billed monthly per active employee. "Active employee" means any user who has not been archived during the billing period. You can upgrade, downgrade, or cancel at any time.
Cancellation takes effect at the end of the current billing period. No partial-month refunds are issued unless required by applicable law.
We reserve the right to change pricing with 30 days' advance notice. Continued use after the notice period constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to:
- Use AwayOps for any unlawful purpose or in violation of any local, national, or international law.
- Attempt to gain unauthorised access to any part of the platform or another Customer's data.
- Introduce malware, viruses, or any other harmful code.
- Reverse-engineer, decompile, or disassemble any part of the platform.
- Use automated scripts to scrape, crawl, or overload the platform.
6. Data & Privacy
AwayOps processes employee data on behalf of Customers as a data processor. Customers are the data controller and are responsible for ensuring they have appropriate legal basis to process their employees' data. See our Privacy Policy for full details.
We implement industry-standard security measures including encryption at rest and in transit, access controls, and regular backups.
7. Intellectual Property
AwayOps and all associated trademarks, logos, and software are the intellectual property of AwayOps Ltd. These Terms do not grant you any rights to our trademarks or branding. Your data remains yours — we claim no ownership over content you upload or generate.
8. Service Availability
We aim for 99.9% uptime and publish our status at status.awayops.com. Planned maintenance will be announced in advance. We are not liable for downtime caused by factors outside our control (force majeure, third-party infrastructure failures, etc.).
9. Limitation of Liability
To the maximum extent permitted by applicable law, AwayOps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the platform.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.
10. Termination
Either party may terminate at any time. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your data will be retained for 30 days and then permanently deleted unless a data export has been requested.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by consumer protection laws in your jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you by email and in-app notification at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.
